Terms & Conditions

Disclosure:

Our complete terms and conditions are contained below, but some important points for you to know before you become a customer are set out below:

  • We may cancel, at any time before delivery and for whatever reason, a service that we have previously accepted.
  • We will have no liability for any Third Party Software, or any unavailability of or delay in providing a consultation or treatment due to a failure of Third Party Software, or any liability caused or contributed to by information you provide to us in connection with these Terms.
  • Our liability under these terms is limited to the price paid by you for the products the subject of the relevant claim, and we will not be liable for consequential loss.
  • We will have no liability for loss of, or damage to, the products, any injury or loss to any person, failure or delay in providing the products or a breach of any law, where such loss was caused or contributed to by any event or circumstance beyond our reasonable control or act or omission of you or your related parties;

We may amend these Terms at any time by publishing updated terms on our Site.

Nothing in these terms limit your rights under the Australian Consumer Law.

We and our employees are not medical practitioners or health professionals, and do not give medical advice, treatment or diagnoses. You acknowledge and agree that the consultations, services and our recommended products are not intended to diagnose, treat, cure or prevent any disease or condition, and you are solely responsible for determining the suitability of our products for your circumstances, and your reliance on our recommendations or products is at your own risk. You acknowledge and agree that nothing in the consultation, on our site or provided with the products may be taken to be medical advice, treatment or a diagnosis by us or our staff, nor are they intended to be a substitute for consulting a medical practitioner. If you have any health or medical issues or concerns, you agree to speak with an appropriately qualified medical professional prior to participating in a consultation or treatment with us.

Bookings

All bookings require a 50% deposit that is due at time of booking to secure the time slot, which will be deducted from the total cost of the appointment. You will receive a pre-appointment consultation form (different depending on the services requested) after your booking via email and SMS. You will be required to provide us with details relating to your medical history, known allergies, skincare issues and any other information we reasonably require in order to make informed recommendations regarding our services or products.

You will also receive several appointment confirmation/reminders varying in weeks & days before your appointment date via SMS/Email.

Please ensure you confirm your appointment within 48 hours by paying the deposit via the email link sent immediately after booking. Any booking not confirmed beyond 48 hours will be cancelled or offered to other clients. If this occurs, we will contact you and make arrangements to reschedule your appointment.

Wait List

We offer a waitlist in our software and any client can add their name into the waitlist for any given day and time. 

Cancellation Policy

We have a strict rescheduling / cancellation policy.

You must provide a minimum of 24 hours notice prior to your scheduled booking time to change or cancel your appointment. If you do not provide us 24 hours notice you will forfeit your deposit.

If you cancel your appointment, giving us more than the 24 hours minimum notice period your booking deposit will be refunded back onto the card used at the time of booking.

***Note*** We understand that in life things can happen outside of your control, therefore management reserves the right to change/vary company policies on a case by case basis. Please communicate when and if this occurs.

No-Show Policy

We strive to provide the best possible experience for our clients and we will not be able to complete a service if you are running late by more than 30 mins. After 30 mins late to any booking, it will be deemed as a no-show and you will forfeit the deposit held against the booking.

Running Late

If you find yourself running late to your appointment, please notify us as soon as possible. We will always try and accommodate our clients where possible. 

Refunds

We do not refund skincare items, personal care items or, supplements or for change of mind. We also do not refund any services unless there is equipment malfunction or breakdown. All product purchases are final, and we cannot accept exchanges or product returns due to risk of contamination. We will only offer an exchange if the product is unopened, packaging is un touched and not opened. You will be required to return the product to the clinic within 7 days of purchase for assessment from the manufacturer.

  • The Club costs $15 per week paid by direct debit or a chosen debit or credit card.
  • This plan includes 4 x Full HIFU Sessions over 12 months, which individually can be Face OR Neck OR Stomach sessions. Each session includes the Full Face OR Full Neck OR Full Stomach area depending on what service you have each time.
  • One Full Cosmeceutical Facial each time you have your HIFU treatment within the plan.
  • 10% Discount off all Beauty By Jemma Services across the board whilst the membership is active.
  • 10% Discount off all Beauty By Jemma Products across the board whilst the membership is active.
  • One Birthday Gift each year you are in the membership program.
  • Priority Bookings (Advance Bookings) You may book all your 4 services in advance on any day and time you choose.
  • Access to before release special clinic offers. All Social Media Deals will be given to Club Members first before the public.
  • Membership only specials and offers as they are released. These are not available online or on social media.

Foundation Club Membership Rules

  • The membership is for a fixed 12 month period. 
  • You cannot cancel your membership within the 52 week period. After that your membership will auto renew. 
  • Payment plans cannot be cancelled once started.
  • Plans can be paused for up to 3 months due to financial hardship, personal hardship or illness. During this time no benefits can be claimed.
  • Plans are not transferrable to another person.
  • Standard clinic terms apply for Late Arrivals and No shows. If you cannot make an appointment, please give us warning of more than 24 hours. If not cancellation fees apply these will be simply deducted from the payment plan.
  • Loyalty card points or credits do not accumulate for Repayment plan services.

Purchased Gift Cards

Online or In Store bought gift cards can be used towards any of our full price services. They cannot be used or redeemed against our various social media specials, temporary promotions or discounted offers that we run time to time throughout each year. No cash is given as change where the price of the purchased item is less than the value of the gift card offered. Any remaining funds are retained on the gift card for future purchases.

  • Gift Cards are valid for 3 years from date of purchase. (This date does not apply to reloaded or cards that can be topped up)
  • Gift Cards can be a physical or virtual card sent via email or SMS.
  • Gifts cards can be topped up/reloaded at any time.
  • No limit on the number of transactions that can be used per gift card.
  • No fees apply to gift cards
  • Gift cards cannot be refunded

Referral Offer

Any new client who refers a new client to us will receive a $50 Gift Voucher redeemable against any product or service that we provide. The gift card will be added to the Referrer’s Beauty By Jemma account after the referred person has attended our clinic and paid for a service.

User Generated Content

We encourage you to interact with us on social media.

You may be permitted to post, upload, or submit content, such as text, images, videos, and other materials. You retain ownership of the content you submit. By submitting content, you grant Beauty By Jemma a worldwide, royalty-free, perpetual, and irrevocable right and license to use, modify, adapt, publicly display, and distribute your content for the purpose of operating and improving our services. You are solely responsible for the content you submit. You must not post content that is illegal, defamatory, infringing on intellectual property rights, or violates the rights of others. We reserve the right to remove or refuse to post any content.

You may request that any of your user content is removed from the site or social media by sending us an email to the address at the end of these terms. We will endeavour to action any removal requests within a reasonable time.

Use of the Site

  1. You accept these terms by making a booking or placing an order via the site or by phone.
  2. Any information you provide to us will be treated in accordance with our Privacy Policy. You agree that any information you provide to us in relation to, as well as before, during and after a booking, is true, correct and complete. Despite anything to the contrary, to the maximum extent permitted by law, we will not be liable for, and you waive and release us from and against any liability caused or contributed to by, arising from or connected with any information you provide to us in accordance with this clause.
  3. You acknowledge and agree that the cancellation policy or no-show fee, as applicable, is a genuine pre-estimate of our loss suffered as a result of your failure to provide us notice of your inability to attend your scheduled appointment.
  4. You must not use the site and/or place an order for products through the site unless you are at least 18 years old.
  5. When using the site, you must not do or attempt to do anything that is unlawful or inappropriate, including:
    • anything that would constitute a breach of an individual’s privacy (including uploading private or personal information without an individual’s consent) or any other legal rights;
    • using the site to defame, harass, threaten, menace or offend any person;
    • using the site for unlawful purposes;
    • interfering with any user of the site;
    • tampering with or modifying the site (including by transmitting viruses and using trojan horses);
    • using the site to send unsolicited electronic messages;
    • using data mining, robots, screen scraping or similar data gathering and extraction tools on the Site; or
    • facilitating or assisting a third party to do any of the above acts.

General Conditions of Sale

This website is operated by Beauty By Jemma. These terms and conditions are between us and you, the person scheduling a consultation, service or placing an order for products through the Site.
